TOPSY – Terms & Conditions

Welcome to TOPSY (“we”, “our”, “us”). These Terms & Conditions (“Terms”) govern your access and use of the TOPSY mobile application, website, and all related services (collectively, “Services”).
By registering, accessing, or using TOPSY, you agree to these Terms. If you do not agree, you must stop using the platform immediately.

1. Definitions

“User” – Anyone who uses TOPSY (riders, customers, receivers).

“Driver/Partner” – Individuals offering transportation or delivery through TOPSY.

“Delivery” – Pickup and drop-off of parcels.

“Ride” – Passenger transportation.

“Platform” – TOPSY app, website, backend services.

2. Eligibility

To use TOPSY, you must:

For Riders/Customers

Be at least 18 years old

Provide accurate registration information

Use a valid payment method

For Drivers

Be at least 21 years old

Hold an active Ghana driver’s license

Have a registered and roadworthy vehicle

Pass TOPSY’s verification and background checks

Comply with all Ghana Road Traffic Regulations

3. User Accounts

You must create an account using accurate personal information.

You are responsible for maintaining the confidentiality of your login details.

You are responsible for all activities done under your account.

Providing false or misleading information may lead to account termination.

4. Use of Services

By using TOPSY, you agree:

Not to engage in illegal, harmful, or fraudulent activities

Not to harass, threaten, or harm drivers, riders, or support staff

Not to interfere with the proper functioning of the app

Not to use the platform to transport illegal goods, weapons, drugs, or hazardous materials

To comply with Ghanaian laws while using the Services

5. Rides & Delivery Services

5.1 Rides

Drivers are independent contractors, not TOPSY employees.

TOPSY only provides a platform to connect riders and drivers.

Drivers have the right to accept or decline requests.

Riders must behave respectfully and responsibly during trips.

5.2 Deliveries

Users must ensure packages:

Do not contain illegal, fragile, explosive, or hazardous items

Are properly sealed

Are accurately described in the app before dispatch

TOPSY and drivers reserve the right to open suspicious packages or refuse transport.

6. Payments

All ride and delivery charges are displayed in the app before confirmation.

Payments must be made through accepted methods (Mobile Money, cards, in-app wallets).

Prices may vary based on traffic, demand, distance, or promotions.

TOPSY may charge additional service fees, cancellation fees, or waiting fees.

6.1 Refunds

Refunds are handled case-by-case based on investigations.

Completed rides or deliveries are not automatically refundable.

7. Cancellation Policy

Riders

You may cancel a ride or delivery request before a driver accepts it.
Cancellation fees may apply if:

A driver is already en route

You delay pickup beyond the waiting time

You repeatedly cancel or misuse the platform

Drivers

Drivers may cancel rides only for valid reasons such as:

Unsafe environment

Rider no-shows

Unavailability of parcel or incorrect details

Repeated cancellations may lead to suspension.

8. Driver Obligations

Drivers must:

Maintain a clean, roadworthy vehicle

Treat riders and customers with respect

Follow Ghana traffic laws

Not consume alcohol or drugs while driving

Ensure safety of passengers and parcels

Accept responsibility for any damage caused by negligence

9. User Conduct

Users must not:

Abuse, insult, or threaten drivers

Damage vehicles or parcels

Avoid or falsify payment

Attempt to cheat or manipulate the system

TOPSY may suspend or delete accounts without notice for violations.

10. Ratings & Feedback

TOPSY uses a rating system to maintain service quality.

Ratings must be honest and respectful.

TOPSY may remove abusive or defamatory feedback.

Drivers with consistently low ratings may be removed from the platform.

11. Promotions & Credits

Promotional offers may be changed or withdrawn anytime.

Credits or discounts cannot be exchanged for cash.

Misuse of promotional offers may lead to suspension.

12. Liability Disclaimer

12.1 Platform Role

TOPSY is not a transportation or delivery company.
We only connect riders/customers with independent drivers.

12.2 Limited Liability

TOPSY is not responsible for:

Delays, cancellations, or driver decisions

Damage to parcels caused by improper packaging

Lost items left in vehicles

Accidents or incidents caused by drivers

Misconduct or criminal behavior of users or third parties

Users agree to use TOPSY at their own risk.

13. Insurance

TOPSY does not provide personal accident, parcel, or vehicle insurance coverage.
Drivers must have valid insurance as required by Ghana law.

14. Privacy Policy

Use of TOPSY is also governed by our Privacy Policy, which explains how personal data is collected and used.
By using the platform, you agree to the Privacy Policy.

15. Account Suspension & Termination

TOPSY may suspend or terminate accounts if users:

Violate these Terms

Participate in fraud or criminal activity

Abuse drivers, staff, or other users

Provide false information

Misuse promotions or payment systems

Users may also request account deletion at any time.

16. Intellectual Property

All logos, designs, trademarks, and app content belong to TOPSY.

You may not copy, modify, distribute, reverse-engineer, or resell any part of the platform.

17. Governing Law

These Terms are governed by the laws of the Republic of Ghana.
Any disputes shall be resolved under Ghanaian jurisdiction.

18. Updates to Terms

We may update these Terms periodically.
Continued use of TOPSY after updates means you accept the revised Terms.
